Urban land-use planning

At its meeting on 9 April 2025, the joint municipal committee of the Neuenhaus joint municipality approved the draft for the 40th amendment to the land use plan and the public display. The amendment to the land use plan is intended to designate land in the Frensdorfer Wald area as a "wind energy" special area.

The following environmental information is available for the urban land-use planning:

• Environmental report pursuant to Section 2a of the German Building Code (BauGB) on the 40th amendment to the land use plan
  • Inventory and assessment of environmental protection issues, including nature conservation and landscape management, in particular:
    • the environmental impact on humans, human health and emissions
    • the impact on animals and plants, biodiversity, species and protected areas and objects
    • the impact on land, soil, water, climate and air
    • the impact on the landscape
    • the impact on cultural and other material assets
    • Species protection
    • Statements on the European network - Natura 2000
    • the interactions of the above-mentioned issues
    • Vulnerability to major accidents and disasters
  • Impact forecast and environmentally relevant measures
• Species protection report with annexes to the 40th amendment to the land use plan
• Preliminary assessment of the fauna-flora habitat (FFH) for the 40th amendment to the land use plan for the FFH area "Bergvennen & Brecklenkampse Veld"
• Comments from authorities and other public agencies from the participation procedure in accordance with Section 4 (1) BauGB (from 25/09/24 to 25/10/24) and private comments from the participation procedure in accordance with Section 3, 1 BauGB (early public participation) including proposals for consideration
  • on basic requirements and notes on the environmental report (district of Grafschaft Bentheim)
  • with statements on the wind energy site in the forest, species protection considerations, impact regulations, impairment of the natural environment, protection of the forest and forest function, fire protection, soil protection and regional planning/spatial planning (district of Grafschaft Bentheim)
  • Local recreation and utilisation of the forest and proximity to the monastery ponds (City of Nordhorn)
  • Information on the forest, risk of forest fires, fragmentation of forest areas and destruction of the internal forest climate, species protection, breeding birds, biotope network, impairment of residential use, avoidance measures (Nabu Emsland/Grafschaft Bentheim)
  • Effects on the forest (Landesjägerschaft Niedersachsen)
  • Notes on the distances to residential buildings (Gemeente Dinkelland)
  • Information on health risks for neighbouring residents, impact on flora and fauna, noise pollution and shadow impact, proximity to potential residential areas (Stichting Buurtschagsraad Lattrop-Breklenkamp)
  • Soil and flood protection, information on forest and species protection (Grasdorf neighbourhood)
  • Basic information on wind turbines, health effects on residents, flora and fauna, Natura 2000 areas Bergvenne and Brecklenkamps Veld (residents of Breklenkamp and the area around Frensdorfer Wald)

The draft plan and annexes will be published from 28 April 2025 up to and including 30 May 2025 in accordance with Section 3 (2) BauGB at www.neuenhaus.de.

In addition, the draft plan and annexes are available for public inspection during office hours at the town hall of the Neuenhaus joint municipality, Veldhausener Straße 26, 49828 Neuenhaus, in the citizens' office. There is a general opportunity for comments and discussion during the publication period. Comments can be submitted by e-mail, post (see address above), fax or for recording.

Comments that are not submitted on time may be disregarded when the decision on the urban land-use plan is made. An association within the meaning of Section 4 para. 3 sentence 1 no. 2 of the German Environmental Appeals Act (UmwRG) is excluded in an appeal procedure pursuant to Section 7 para. 2 of the UmwRG in accordance with Section 7 para. 3 sentence 1 of the UmwR with all objections that it did not assert or did not assert in good time within the publication period but could have asserted.
